Official Contest Rules

THIS PROMOTION IS INTENDED FOR USE IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

1. ELIGIBILITY: NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR CLAIM PRIZE. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING. The Barritt’s Bermuda Getaway Recipe Contest (“Contest”) is open only to individual, legal residents of the 50 United States and the District of Columbia, who are 21 years of age or older at the time of entry. Void where prohibited or restricted by law. Employees, officers and directors (and each of their respective IRS dependents, immediate families (spouse, siblings, children, parents and their respective spouses) and those living in the same households, whether or not related) of Barritt’s Beverages International, North American Beverage Company and their distributors, The Bermuda Department of Tourism and each of their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win a prize. By participating, entrants agree to be bound by these Official Rules.
   
   
2. TO ENTER: The Contest begins at 12:00:01 AM (EST) on January 3, 2011 and ends at 11:59:59 PM (EST) on April 17, 2011 (the “Promotion Period”). During the Promotion Period visit www.barrittsgingerbeer.bm/recipe_contest to enter. Follow the directions online to submit your entry by typing your original recipe into the supplied text area. Entries must be received by 11:59:59 PM (EST) on April 17, 2011. In your submission you must include the name of your cocktail recipe including a complete list of ingredients, exact measurements and complete preparation instructions. Your cocktail recipe must include at least one fluid ounce of Barritt’s Ginger Beer. Entrants are encouraged to incorporate readily available ingredients in their recipes to increase their chance of winning. You may enter as many different cocktail recipes as you wish. Recipe must be original, created solely by submitting entrant, unpublished and cannot infringe upon any rights of any third party including but not limited to copyright, trade name, property rights, and rights of privacy or publicity or any other rights of any person or entity. Sponsor reserves the right to disqualify any entry it deems to be inappropriate, offensive or is not in keeping with Sponsor’s image, at its sole discretion. Any entry submissions which do not contain all required information and/or recipes that do not include the required ingredient, or in the sole opinion of Sponsor, is deemed not to be original or is deemed to be inappropriate for publication will be disqualified. All Contest entries become the sole property of the Sponsor and will not be acknowledged or returned. Released Parties (as defined below) are not responsible for illegible, lost, late, damaged, incomplete, inaccurate, delayed or misdirected entries or for computer system, phone/cable line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Use of Automated devices is prohibited.
   
   
3. JUDGING: All eligible entries received will be judged by a panel of independent, qualified judges whose decisions are final and binding in all judging matters. Each cocktail recipe will be evaluated based on its taste, appearance, overall drinkability and innovation. The Judges and qualified representatives from the Sponsor will determine the Grand Prize winner. Potential winners will be notified by phone, email, US Mail and/or overnight mail on or about June 1, 2011.
   
   
4. PRIZES: One (1) Grand Prize: a trip for two (2) to Bermuda. The trip will include roundtrip coach airfare for winner and one (1) guest from and to an airport nearest winner’s city and state of residence to Bermuda, 3-nights/4-days hotel accommodation (one room, double occupancy), as determined by Sponsor. All travel must take place prior to March 31, 2012 or prize will be forfeited. Travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Prize does not provide spending money; all extras are at winner’s own expense. Travel must be roundtrip. Sponsor will determine flight itinerary and hotel accommodations in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Prize value is estimated at $4000.00 (USD). Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value.
   
   Winner and guest are solely responsible for obtaining any required travel documents and travel insurance. All taxes, fees and surcharges on the Grand Prize are the sole responsibility of winner.
   
   No substitution, assignment or transfer of prize permitted by winner. Prize cannot be redeemed for cash, however, Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion if an advertised prize becomes unavailable. All federal, state and local taxes and any other costs and expenses associated with the acceptance and use of any prize not specified herein are the sole responsibility of winner. All prizes will be awarded provided a sufficient number of eligible entries are received.
   
   
5. OWNERSHIP/USE: Submission of an entry constitutes the entrant’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in the entry, including, without limitation, all copyrights. By submitting an entry, entrant warrants that (i) cocktail recipe is original, created solely by submitting entrant and (ii) entry does not infringe upon any rights of any third party including but not limited to copyright, trade name, property rights, and rights of privacy or publicity or any other rights of any person or entity. Entrant further agrees that Sponsor shall own the entry submitted (including all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party. In addition, each winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have in the recipe.
   
   
6. GENERAL CONDITIONS: Entrants agree that Sponsor and each of their respective parents, subsidiaries and affiliated companies and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives, agents (collectively, the “Released Parties”) will have no liability whatsoever for, and are released and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or prize certificate or participation in this Contest or in any Contest-related activity. The winner (i) by acceptance of prize, except where legally prohibited, grants permission for Sponsor (and agrees to confirm such agreement in writing) and its designees to use his/her name, recipe, photograph, voice and/or likeness and prize information for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered world wide and on the Internet and/or World Wide Web without notice or review or approval; and (ii) will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and a Publicity Release, where lawful. If Affidavit/Release is not received by the date listed on the notification, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, or if prize notification or prize is returned as undeliverable, prize will be forfeited and, at Sponsor’s discretion, awarded to the runner-up. Released Parties are not responsible for mechanical, technical, human or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes or in any Contest-related materials. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and select the potential winners from all eligible, non-suspect entries received prior to such action using the judging procedure outlined above.
   
   
7. WINNERS LIST: To obtain the name of the winner send a self-addressed, stamped business-size envelope to: North American Beverage Co.,“Barritt’s Bermuda Getaway Recipe Contest” Winner, 901 Ocean Avenue, Ocean City NJ 08226. Winner list will be sent after winner has been verified and prize has been awarded. Request must be received by May 27, 2011.
